Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

ArtsHaze means the sole proprietorship operating under the name ArtsHaze.

Customer means any natural person purchasing products from ArtsHaze for purposes outside their trade, business or profession.

Agreement means any contract concluded between ArtsHaze and the Customer through the website.

Website means www.artshaze.com.

Products means all products offered by ArtsHaze.

Print-on-Demand Partner means the external production and fulfilment partner responsible for manufacturing and shipping products on behalf of ArtsHaze.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by ArtsHaze and to every agreement concluded through the Website.

Before an agreement is concluded, these Terms & Conditions are made available to the Customer. By placing an order, the Customer confirms that they have read and accepted these Terms & Conditions.

Should any provision of these Terms & Conditions be held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 4 – Products & Offers

ArtsHaze aims to describe and present all products as accurately as possible.

Product photographs, colours and mock-ups are intended to provide a realistic representation of the products. However, slight differences in colour or appearance may occur due to screen settings, lighting conditions and the production process.

Obvious errors, typographical mistakes or pricing inaccuracies do not bind ArtsHaze.

ArtsHaze reserves the right to modify or discontinue products without prior notice.

Article 5 – Orders & Agreement

An agreement is concluded once the Customer completes the checkout process and payment has been successfully received.

ArtsHaze will send an order confirmation by email.

ArtsHaze reserves the right to refuse or cancel an order where fraud, misuse or payment irregularities are suspected.

Article 6 – Pricing & Payment

All prices displayed on the Website include VAT where applicable.

Shipping costs are shown separately during checkout.

Payments are processed securely through trusted third-party payment providers.

ArtsHaze reserves the right to correct obvious pricing errors before fulfilling an order.

Article 7 – Production & Delivery

All ArtsHaze products are manufactured exclusively on demand after an order has been placed.

Estimated delivery times shown on the Website are estimates only and are not guaranteed delivery dates.

ArtsHaze cannot be held responsible for delays caused by shipping carriers, customs authorities or circumstances beyond its reasonable control.

Risk of loss or damage transfers to the Customer upon successful delivery of the order.

Article 8 – Order Changes & Cancellations

Because every product is manufactured on demand, production begins shortly after an order has been confirmed.

Customers wishing to modify or cancel an order should contact hello@artshaze.com immediately.

Where production has not yet started, ArtsHaze will make reasonable efforts to accommodate the request.

Once production has commenced, changes or cancellations may no longer be possible.

Article 9 – Returns & Statutory Consumer Rights

Customers wishing to return an order or exercise any applicable statutory consumer rights should contact ArtsHaze at hello@artshaze.com before returning any products.

As all products are manufactured exclusively on demand, return requests are assessed individually and handled in accordance with the applicable consumer protection laws governing the purchase.

If an order arrives damaged, defective or incorrect, the Customer must notify ArtsHaze within 7 days of delivery and provide photographs of both the product and the packaging.

Where appropriate, ArtsHaze may provide:

• a replacement product;
• a full or partial refund; or
• another suitable solution.

Nothing in these Terms & Conditions limits or excludes any mandatory consumer rights that cannot legally be limited or excluded under applicable law.

Article 10 – Intellectual Property

All artwork, illustrations, graphics, product photography, branding, logos, texts, website design and other content displayed by ArtsHaze are protected by copyright, trademark rights and other applicable intellectual property laws.

Purchasing an ArtsHaze product does not transfer any copyright or intellectual property rights.

Products purchased from ArtsHaze are intended for personal, non-commercial use only.

Without prior written permission from ArtsHaze, Customers may not:

• reproduce artwork;
• scan or digitise artwork;
• modify artwork;
• distribute artwork;
• publish artwork;
• sell reproductions;
• use artwork commercially;
• use artwork for AI training, machine learning datasets or generative AI systems;
• create derivative works based on ArtsHaze designs.

Any unauthorised use may result in legal action.

Article 11 – Limitation of Liability

ArtsHaze shall not be liable for indirect, incidental, consequential or special damages arising from the use of its Website or Products, except where liability cannot legally be excluded under applicable law.

Nothing in these Terms & Conditions excludes liability for fraud, gross negligence or any liability that cannot legally be excluded or limited.

Article 12 – Force Majeure

ArtsHaze shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

These circumstances include, but are not limited to:

• natural disasters;
• strikes;
• transport disruptions;
• supplier failures;
• internet or payment outages;
• government measures;
• pandemics;
• customs delays.

Article 13 – Privacy

Personal data is processed in accordance with the ArtsHaze Privacy Policy.

By using the Website and placing an order, the Customer acknowledges that personal information may be processed for the purpose of fulfilling the Agreement.

Article 14 – Governing Law & Jurisdiction

These Terms & Conditions and all agreements between ArtsHaze and the Customer shall be governed by the laws of the Netherlands.

Nothing in these Terms & Conditions affects any mandatory consumer protection rights granted to consumers under the laws of the country in which they reside.

Any disputes shall, where permitted by applicable law, be submitted to the competent court in the Netherlands.
