Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

  • Seller / Entrepreneur: ArtsHaze, the sole proprietorship of Dore Quattrocchi, responsible for offering products via www.artshaze.com.
  • Customer: The natural person who is not acting in the course of a trade or profession and enters into a distance agreement with the entrepreneur.
  • Distance Agreement: A contract concluded within the framework of an organized system for distance selling, using one or more means of remote communication.
  • POD Partner: The external production partner, in this case Gelato, who prints and ships the products directly to the customer.
  • Right of Withdrawal: The customer's right to withdraw from the distance agreement within the statutory reflection period.
  • Durable Data Carrier: Any tool (including email) that enables the customer or entrepreneur to store information directed to them personally in a way that allows future consultation and use for a period appropriate to the purpose of the information.

Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

These general terms apply to every offer made by the entrepreneur and to every distance agreement concluded between the entrepreneur and the customer.
Before the distance agreement is finalized, the customer will be provided with these terms and conditions. If this is not reasonably possible, the customer will be informed on how to access the terms and that they will be sent free of charge upon request.
Situations not covered by these terms shall be interpreted in the spirit of these general conditions.

Article 4 – The Offer

The offer includes a complete and accurate description of the products offered. The description is detailed enough to enable proper evaluation.
Obvious mistakes or errors do not bind the entrepreneur.
Each offer includes clear information about the rights and obligations that come with acceptance.

Article 5 – The Agreement

The agreement is concluded at the moment the customer accepts the offer and fulfills the associated conditions.
The entrepreneur confirms the order via email.
If the agreement is made electronically, the entrepreneur ensures secure data transmission and a safe ordering environment.
The entrepreneur reserves the right to assess the customer's ability to fulfill payment obligations within legal limits.

Article 6 – Right of Withdrawal

Customers have the right to withdraw from the agreement within 14 days after receiving the product, without giving a reason.

Exception:
Products that are made to order (such as print-on-demand art, personalized posters, or custom items) are excluded from the right of withdrawal under Article 6:230p of the Dutch Civil Code.
Since all items in the ArtsHaze store are made-to-order via POD, the right of withdrawal does not apply.

If a product arrives damaged, incorrect, or defective, the customer must report this within 7 days of delivery via hello@artshaze.com. In such cases, ArtsHaze will arrange a replacement, repair, or refund.

Article 7 – Customer Obligations During Reflection Period

During the reflection period, the customer must handle the product and packaging with care. Products may only be handled as one would do in a physical store.
If the customer returns a product that has been damaged or used more than necessary, a reduction in value may be applied.

Article 8 – Exercising the Right of Withdrawal

This article does not apply to made-to-order products and is therefore not relevant for ArtsHaze purchases unless otherwise agreed.

Article 9 – Pricing

All prices include VAT and exclude shipping costs unless otherwise stated.
Prices will not be increased during the validity period, except in case of legal adjustments or evident errors.
The entrepreneur is not liable for typographical, pricing, or formatting mistakes.

Article 10 – Delivery & Fulfillment

Orders are processed with care and shipped by our POD partner Gelato to the address provided by the customer.
Estimated delivery times range between 3–7 business days, depending on location. These are not legally binding guarantees.
If an order is delayed or cannot be fulfilled, the customer will be informed as soon as possible.
The risk of damage or loss rests with the entrepreneur until the order has been delivered to the customer or a third party designated by the customer.

Article 11 – Payment

The customer is required to pay in full at the time of ordering.
Payments are processed securely via third-party providers such as Mollie (including iDEAL, PayPal, and credit card).
If payment is not received, the entrepreneur reserves the right to cancel the order.

Article 12 – Force Majeure

The entrepreneur is not obligated to fulfill their responsibilities in case of force majeure.
Force majeure includes, but is not limited to: illness, strikes, disruptions with suppliers or partners, transport delays, or government restrictions.

Article 13 – Intellectual Property

All texts, visuals, designs, and other content on www.artshaze.com are the property of ArtsHaze or its respective designers.
No material may be copied, distributed, or used without explicit permission.
Violations may result in legal action.

Article 14 – Governing Law

All agreements between the customer and entrepreneur are governed by Dutch law.
Disputes shall be submitted to the competent court in the district of the entrepreneur.
